勞動部擬解禁教師罷工　教育部反彈

我國2011年起開放教師組工會，但禁止教師罷工，勞動部近日檢討法令認為，此規定有違國際公約的平等原則，正研擬修法開放教師罷工。對此，教育部和家長團體反對，憂心影響學生受教權。學者則認為，可設計補課等機制因應。
 
勞動部官員今天說，我國簽署《公民與政治權利國際公約》和《經濟社會文化權利國際公約》（俗稱兩公約）後，近日檢討法規時，認為限制教師罷工有違平等原則，故研擬開放教師組企業工會、行使罷工權，最快明年提修法草案。
 
《勞資爭議處理法》規定，工會若遇調薪等勞資爭議時，經調解破裂後，由半數會員投票同意，才能合法罷工，期間僱主可不給薪；教師和國防部所屬單位勞工不得罷工。全國教師工會總聯合會副理事長吳忠泰說，罷工時沒薪水，正當性也要接受檢驗，沒這麼可怕。
 
但教育部次長陳德華說，若老師罷工，學生是「直接受害第三者」，現階段不宜施行。全國家長團體聯盟副理事長謝國清說，教育不像一般工廠生產，若教師罷工，要怎麼解決孩子學習的問題，「罷工期間，孩子要往哪擺？萬一遇到大考呢？」（唐鎮宇、蔡永彬／台北報導）
